House Bill No. 4208 -- "A Bill to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §37-6-31; and by adding thereto a new section, designated §38-1-16, all relating to foreclosures on residential rental property; requiring a landlord to give written notice to a prospective tenant when property is subject to foreclosure; requiring landlord to notify tenants of the commencement of a foreclosure; remedies for failure to provide notice; providing for damages for failure to provide notice; permitting tenants in rental property subject to a foreclosure to occupy the premises until the end of the remaining term of the lease ; providing an exception for successor in interest who desire to reside in the unit as a primary residence; notice requirements; and exceptions to application.
